Case: AR v AR
Philip Way acted for the husband in a complex financial proceedings case where the family’s substantial wealth all came from the husband’s father either by way of gift or inheritance. The court was asked to determine the amount of the lump sum that the wife was entitled. It considered the difficulties of assessing the value of a comparable property where the family home was unique and difficult to replicate, the application of the sharing principle and the weight to be given to factors such as the length of the marriage, the wife’s age and the standard of living enjoyed during the marriage.
